In lieu of forfeiting the deposit, the Substitute Trustee may avail themselves of any legal or equitable remedies against the defaulting purchaser. Real estate taxes shall be adjusted as of the date of sale, all costs of the conveyance, which shall be by special warranty, examination of title, recording charges, notary fees, settlement fees, •including preperation of deed and grantor's tax thereon, etc., will be at the cost of the purchaser. The Substitute Trustee reserve the right: (i) to waive the deposit requirement; (ii) to extend the period of time within which the purchaser is to make full settlement; (iii) to withdraw the property from sale at'any time prior to the termination of bidding; (iv) to keep the bidding open for any length of time; (v) to reject all bids; and (vi) to postpone or set over the date of sale. In the event the Substitute Trustee deem it best for any reason at the time of sale to postpone or continue this sale from time to time, such notices of postponement or setting over will be in a manner deemed reasonable by the Substitute Trustee. Additional terms of sale shall be announced at the time of sale and shall be contained in a memorandum of sale which the successful bidder shall be required to sign.
Written notice of the Trustee Sale was given to the present owner of the property described herein by certified mail to their last known address as such owner adress appear on the records of the noteholder, as required by Section 5559.1 of the Code of Virginia of 1950, as amended.
