— The changes remove considerable acreage from use: “no land disturbing ... within one hundred feet of perennial streams, or within five hundred feet upslope ... of (perennial) springs ...” If a stream crosses property for 1000 inches, there go 4 3/4 acres; one spring eliminates about 9 1/3 acres. Another provision is worse: “Construction on the Conservation Lot shall be such that the structures’ highest elevations are at least fifty feet below the highest elevation on the property.” That rule surely eliminates more acres than the other two, in many instances making an entire lot unbuildable, as Newbill Miller point out. It would also have denied Washington and Jefferson the right to build Mt. Vernon and Monticello where they are!

What benefits result from these costly, intrusive, often absurd new regulations?
— Safer access for rescue and fire vehicles? See comments above.
— Pure water in springs and streams? Perhaps. But consider the spring on the right as you drive west on Route 211 in the Park, closed for contamination a few years ago. There is no human construction or other activity within thousands of feet!
— Minimize or prevent erosion? Very doubtful. It is in the owner’s interest to do so: damaged roads are costly to repair, and an eroded yard must be reworked at the owner’s expense. Most builders today know about erosion control. When damage occurs because of neglect, punish the guilty and require restoration. We don’t need greater costs and regulations imposed on everyone for the carelessness of a few.
