The Circuit Court of Rappahannock County has been asked to reverse a decision by the Washington Town Council which denied a Virginia couple’s request to build a new house in the town.
In a lawsuit filed last Friday seeking $995,382.95 in damages, Sid and Mary Catherine Worley also asked the court to declare "invalid and unenforceable and void" the town's Historic District Ordinance thus making it not applicable to their petition to construct a single-family home on Main Street.
They asked for an injunction preventing the town from enforcing the Historic District Ordinance against them and a jury trial on the damages.
The Historic District Ordinance is "unreasonable, overbroad and impermissibly vague," and does not provide "reasonable, rational or objective guidelines for determining architectural compatibility," according to the suit.
