It is expected that the Konick will appeal the case based the unheard evidence.
“It’s highly unfortunate that a great deal of evidence concerning the complaining witness’ long history of using profanity and vulgar language in the clerk’s office, as well as her racial and ethnic slurs directed towards me and others was all excluded from the trial. Had the testimony of a number of witnesses been admitted the outcome would likely have been different.” Konick told the Rappahannock News after the trial. Davis declined to comment.
