“It is [the ARB members’] obligation to do their homework,” said Shepard.
Most of the changes suggested at the meeting concentrated on the specific language of the ordinance and eliminating “wiggle room” in regulations that could later be exploited by lawyers. Shepard pointed out that much of the language in the proposed ordinance is taken directly from the Virginia state code, making such sections less vulnerable to future challenges.
“All of that language is very important to have in the ordinance,” said Shepard.
The need fof a revised historic preservation ordinance with clearly defined guidelines became clear last year as the result of a court battle over the town’s old Historic District Ordinance. The lawsuit, brought against Washington by Sid and Mary Catherine Worley when the town denied them approval to build their dream house with synthetic building materials, ended with Washington paying a $75,000 settlement and exposed weaknesses in the town’s current Historic District law.
The initial drafts of the Historic District Ordinance and the Historic District Guidelines are available for public review at the Town office and . the County Administrator’s office. The next joint meeting to discuss the proposed Historic District is scheduled for January 23.
