Boundary) In execution of an Order entered November 16, 2006 in Chancery No. 05-36 in the Circuit Court of Rappahannock County, Virginia, the, the undersigned Special Commissioners will offer for sale at public auction on the front steps of the Courthouse Building, 250 Gay Street, Washington, VA on Friday the 12th day of January 2007 at 1:30 PM. the following improved parcel of land located at 82 Hull School Road, Sperryville, Virginia 22740 and more particularly described as follows: All that certain tract or parcel of land with improvements thereon, lying and being situate in Piedmont Magisterial District of Rappahannock County, Virginia, containing 1 acre, more or less, being the same lot of which Mary M. Dwyer died seized and possessed, and acquired by deed dated July 10,1961 recorded In Deed Book 74 at Page 636 in the land records of the Clerk's Office of the Circuit Court of Rappahannock County, Virginia. Rappahannock County Tax Map No. 26-3A TERMS OF SALE: A deposit of $10,000.00 or 10% of the successful bid, whichever is greater, in certified funds payable to BRUCE T. CLARK, Special Commissioner will be required from the highest bidder before the bid is accepted. THIS SALE IS SUBJECT TO CONFIRMATION BY THE CIRCUIT COURT OF RAPPAHANNOCK COUNTY. If the sale Is not confirmed, the deposit will be returned to the purchaser. Upon confirmation of the sale, the balance of the successful bid shall be paid in certified funds at settlement within thirty (30) days from the date of sale; provided that the Special Commissioners may extend the date for settlement for good cause or if an order confirming the sale is pending entry. Purchaser's failure to proceed to settlement within 30 days or on such date as agreed by the Special Commissioners shall be deemed a default by the Purchaser and shall result in the forfeiture of the deposit to the Special Commissioners in payment of fees and costs. Conveyance of title will be by Special Commissioners Special Warranty Deed. The property will be sold AS IS with no representation or warranty as to the physical condition of the property or of any improvements thereon or the use to which the property may be put under applicable zoning or other local ordinances. The fees and costs of the Special Commissioners, Grantor's Tax, any delinquent and pro rata real estate taxes to the date of sale shall be paid from the sale proceeds. All other costs and recording fees shall be paid by the Purchaser at Settlement.
