Tb accept conservation easements for land in a potential alignment could veiy well put it an a messy collision course with the State Corporation Commission (SCC) board, which will decide need for and location of a line.
Asked if VOF would accept easements from Fauquier landowners with property in potential alignments during the power line dispute, foundation president Bob Lee said: “It’s never come up. We don’t have a firm policy.” The VOF board probably will discuss the matter during its January meeting, said the former Fauquier County administrator.
Special assistant to the Attorney General Fred Fisher provides VOF with legal counsel. Has Fisher told VOF not to accept easements for land in potential transmission line paths?
“We don’t have any written direction from the attorney general with regards to this matter,” Lee said. “And, we haven’t specifically asked for it.” Lee refused to say whether or not Fisher has given VOF oral instructions to not accept such easements.
“I think it would be illadvised to repeat conversations Fve had with legal counsel,” he said, adding there would be “no benefit” to the SCC, VOF or the Attorney General’s office to “recapitulate those conversations that may have existed.”
Tb his knowledge, VOF easements never have been used to stop a power line. David Clementson, a spokesman for the attorney general, declined comment on the matter. “Our advice to clients is confidential,” he said.
Warrenton lawyer Randy Parks represents the Chester, Semple and McCarty families as well as Mt. Joy Farm LP and Law Family Partnership, which owns Linden Vineyards. It appears to lie adjacent to a possible alignment. All of them contemplated putting easements on their land before Dominion outlined its plans, Parks said.
