During a closed session after the board’s meeting on Monday afternoon, the supervisors will decide whether to authorize filing suit against B&S’s owners.
Commonwealth’s Attorney Peter Luke said the violation is a misdemeanor with an associated fine of up to $1,000. A court could decide to increase that penalty if violations continue, he said.
Luke added that the county could also file an injunction to recoup legal fees associated with the litigation.
This is an unusual situation, the attorney said, because
the national interest corridor study “just reinforces that Dominion has been accurate in its assessment for this line through this region.”
The SCC has never rejected Dominion’s requests for power lines. But it has changed applications, approving alternatives to the utility’s proposed routes, Anderson said.
In the next few weeks, the SCC will publish a schedule or calendar of events associated with its review of the Dominion proposal. It will include public hearings, one in Richmond and at least one in the proposed line’s region.
