Since then, two opinions from the Virginia Attorney General’s office have held that the trustees acted improperly and violated provisions of the state's Freedom of Information Act (FOI) that requires members to:
1. vote affirmatively in open session to enter executive session, stating in the motion the specific section of FOI which permits the closed meeting,
2. state the purpose for which the closed session is being held,
3. repeat in public any vote taken in executive session.
Despite the rulings from the Attorney General, the trustees refused until Monday to validate actions taken at their June, 1979. meeting.
