—federal court action. If the person disagrees with the appeals council decision, he or she may bring civil action in a Federal court.
The person must ask for a reconsideration within 60 days from the date he or she receives the notice of decision. The person should phone, write, or visit any social security office. The people there will help with the request, which must be in writing.
If the decision is to stop or reduce the amount of the person’s check, he or she has the right to have the payments continued unchanged while the case is being reconsidered. But to do this, the person must apply for a reconsideration within 10 days of the date the notice is received.
