Exemptions: If certified medical reasons, interior car design or the number of occupants in a motor vehicle make child safety seat use impractical they are not Inquired. Safety seats are not required in buses, public transportation, school buses or farm vehicles.

Penalties: Failure to use child safety seats when required may result in a $25 civil fine which will be used toward purchasing and providing seats on loan for those unable to buy one. The court may waive or suspend the penalty if a defendant cannot afford a seat. Failure to have a physician’s exemption statement with you while carrying a child may result in a $10 fine. Violations do not constitute negligence per se and do not constitute defense in any personal injury claim for a child or recovery of accident sustained medical injury expenses. Seats on Loan: Anyone financially unable to buy a child safety seat may apply to the Virginia Department of Transportation Safety to borrow one.
