Luke pointed out that the amended charges against Fincham constituted the lowest grade of both felony and misdemeanor. He described his client's actions as “foolish” but not "heinous crimes" and noted that the fires damaged neither lives nor property.
Luke maintained that community service was a good program for a youthful first offender like Fincham who poses no danger to the public and has already exhibited a marked change since serving six months in jail. “This county doesn’t even have a jail to put him in,” said Luke, adding that if Fincham is incarcerated, his pregnant wife and their young child will have to go on welfare.
