In stipulations to the court, Commonwealth’s Attorney Douglas Baumgardner reported that the defendant, in the company of two other persons, set the fires, then reported them to the Castleton Fire Department and helped put them out. There were no buildings near any of the fire sites, Baumgardner added.
Probation officer Lynn Griffith, who has worked with Fincham since his release after serving six months in jail on conviction of similar charges in Culpeper County, told the judge that she has had “no problems” with the defendant. She concurred with Luke’s request for community service as an alternative to a further jail term for Fincham.
