to leave open the question of restitution until an investigation is completed, however, “It might be appropriate that the fire company is reimbursed for the cost of putting the fires out.”
The offenses charged against Fincham “are indeed quite serious" but it’s the court’s responsibility to consider the individual charged with the offenses, an aspect of the criminal justice system least understood by the public, Judge Robertson said. Recalling past histories of other defendants he’s seen in three years on the bench, Robertson described Fincham’s record as “remarkable” in comparison and noted that he was particularly impressed with the stability of the young man's family relationships.
After first ascertaining that someone convicted of a felony could be accepted into the community service program, the judge imposed a 12 months jail sentence for each felony and a $100 fine on each misdemeanor charge. But in consideration of the defendant “as a person,” Robertson suspended both and placed Fincham on supervised probation for three years with the following conditions:
—payment of restitution as determined by the court at a later time,
—receipt of psychiatric counseling as directed by the probation officer;*
—payment of court costs,
—completion of a community service program.
“I believe this will be highly rehabilitative,” the judge told Fincham. “I am on your side... You’re a young man with a lot of promise...! want you to complete the program and be a good and useful citizen in this community.
