Kidwell’s first hearing befor a panel of 12 county jurors ended in a mistrial when the panel could not reach a unanimous verdict, split 11-1 for acquital. In Kidwell’s second trial, the jury deliberated eight hours before finding her not guilty, finding that she acted in self-defense when she shot Spellman.

In a postscript, the rightof-way dispute that provoked the tragedy was heard by Judge Shore Robertson in December. Robertson is expected to announce his ruling in January on the Kidwell’s request for a permanent injunction prohibiting improvements to the right-ofway that crosses their property.
