Judge Carleton Penn denied all six defense motions — five for a new trial in Loudoun Circuit Court and one for an acquittal (on the grounds of insufficent evidence by law).

A jury found the 65-year-old retired Army colonel guilty Aug. 30 of second-degree murder and gave him five years in prison. Judge Penn has scheduled sentencing for Dec. 6. He may suspend any or all of the defendant’s time in prison.

Park best in state

Rose Hill Park in Berryville was picked as the best gardening project in Virginia by the judging team of Family Circle magazine.

The publication is sponsoring a “Make America Beautiful” contest in cooperation with Hyponex and Bedding Plants Inc.

The park, on land donated to the town of Berryville by Graham Smithy, has been adopted by almost every community organization in Clarke County as well as garden clubs and individuals.

Mall won’t come down

The Warrenton Town Council voted 5-2 last Tuesday to grant a local developer’s appeal of a Sept. 13 decision by the Architectural Review Board.

If the council had sided with the board, Phillip Green either would have had to tear down or brick up part of his mini-mall under construction at Fifth and Homer streets.
