But there’s no requirement for setting pins and markers on the 51 acres now belonging to the Wagners because that is residue under the terms of the county’s ordinances and not by definition a subdivided lot, Mr. McCarthy told the BZA. As to "Mr. Morehouse’s first point, “I’ll ac,cept his allegation that the work Wasn’t done,” Mr. McCarthy said, •explaining that the remedy lies in going back to Mr. Coveil and demanding that he finish the job. But .Mr. Coveil died a year and a half ago, and the Bealeton surveyor who took over his business recently suffered an incapacitating heart attack, the zoning administrator reported.

That leaves the question begging until a new survey is completed. Mr. ^Morehouse insists that the Wagners pay for this new survey; Mrs. Wagner maintains that her survey shows the road on her property and that if Mr. Morehouse takes exception, he should have the property resur.veyed.

BZA member Peter Kramer asked how far might the road extend onto the Morehouse land.

“If there is encroachment, it could be two inches; it could be two feet,” Mrs. Wagner replied. “No one Imows.”

The question of the incompleted survey is a civil matter, Mr. Reynolds acknowledged, saying that while Mrs. Davis still retained the property, Mr. Morehouse had a claim against her. Since the sale of the property - and the disputed boundary line - to the Wagners, “it looks like he’s trying to hold them up (on the bed-and-breakfast permit) but this is sort of his last chance, you might say.”

Mrs. Wagner had agreed in writing that if a subsequent survey finds encroachment, she would have the road moved as soon as she is “financially able” to do so.
