However, Mr. Morehouse did not raise this point until 1986, when Mrs. Davis sought to further subdivide her 109-acre parcel by cutting off two up-hill lots of 25 and 33 acres. Over Mr. Morehouse’s objections, the Board of Supervisors permitted the two-lot subdivision by special exception. (The two lots would have put Mrs. Davis over the five-lot maximum which could have been approved administratively under the old Rappahannock zoning ordinance. That ordinance required her to seek a rezoning from agricultural to rural residential before proceeding with the subdivision process, but an Attorney General’s ruling held that this provision mixed legislative zoning functions with administrative subdivision approval functions and
