A way out?

“I hear them saying, ‘We withdraw the amendment. Now you find us a way out of this’,” noted Commissioner Fannon.

Presenting his draft proposal as an alternative, Mr. McCarthy said it would eliminate the perception that there’s a race to his office for approval of family transfers and reduce the possibility that the option of dividing a family lot could be taken away without knowledge by another landowner (whose property was part of the same parcel in 1962). As to whether the amendment will help Mrs. Doares, “we’ll have to get a legal opinion,” he added.

The limitation to one family transfer per parcel in a calendar year and the requirement for notice to other affected landowners of such transfer will be advertised for public hearing at the Planning Commission’s July meeting.

Also at last Wednesday’s session, the planners recommended:

• Changing the term of an agricultural and forestal district from eight to 10 years and increasing the minimum lot size for subdivisions in such districts from 26 to 50 acres.

• Recommended that the Board of Zoning Appeals grant a special use permit to Jerry and Mary Beth Martin to operate a one-bedroom bed-and-breakfast in their residence on the Fodderstack Road.

• Recommended issuance of a special use permit to Richard Simmons for a small engine repair business as a “cottage industry” in an existing accessory building on a 1.5acre lot on Route 638.
