Rappahannock County’s Board of Zoning Appeals voted to grant a variance from side setback requirements to allow Mr. and Mrs. Paul Foster Jr. to build a house on their property in the Blue Ridge Estates subdivision on Chester Gap.
The Fosters’ lot is 60 wide by approximately 300 feet deep, and they want to build a house that is 24 feet toide. The zoning ordinance requires 20 feet of setback on each side. Without a variance the house couldn’t be wider than 20 feet to allow 20 feet on both sides of a 60-foot wide lot.
Mr. Foster said he had written Several times to the owner of the adjbining lot, who lives in Maryland, to j(sk if they could purchase her lot but has never received a reply. He said they have owned their lot since 1985, and are living in a house that is about to be sold.
County Administrator John McCarthy pointed out that in 1985, when the Foster lot was purchased, the setback requirement was ten feet on each side.
