In other similar situations lot owners have purchased two such lots to enable them to have enough land for a house site, but the Fosters’ lot is deep enough to allow room for the well and septic system, so only the side lot requirement prevented them from building on the lot.
Hampton District representative Lee Bird pointed out that the law allows the BZA to grant a variance for a non-conforming lot, if the adjoining properties are in separate ownership, and if the lots were recorded prior to the adoption of the county’s first zoning ordinance in 1973. The lots in Blue Ridge Estates were recorded in 1958.
