You are an honest person. You've always made business deals with a handshake. Now, when you want to buy or sell a house, you find that everything has to be in writing. Why is this?

Every state has enacted laws to protect buyers and sellers in volved in land and home sales from misunderstandings, needless disputes, and the occa sional unscrupulous operator. For this reason, real estate listings. offers, acceptances, bind ers. options and deeds are usually required by law to be exe cuted in writing to be enforcea ble. In addition, in most states, mortgages and leases with a term greater than one year, must also be in writing. The laws may seem overly conservative, how ever, the purchase and sale of property is the largest financial transaction in which most of us engage in our lifetimes. Isn't it nice to be protected?

A home buyer or seller is enti tied to know EXACTLY what he is buying or selling and under what terms before being asked to make a substantial commitment with potential long term conse quences.
