The suit sought an injunction barring the ban on land disposal of sludge from going into effect, claiming there was no other remedy at law open to the claimants. Mr. Gilliam said “They can’t have it both ways.” They should not have sought damages while claiming an injunction was the only avenue open to them.
The response also notes that as far as the county knows, none of the claimants ever applied for a permit to have sludge spread on their land.
Mr. Gilliam said that the next move is up to the court, which will set a date for hearing motions. He said he had no idea, when the date would be set.
He is scheduled to meet with the members of the Board of Supervisors in executive session during their regular meeting Monday.
