The county won an early round in the sludge suit in Federal Court in Charlottesville last month when Judge B. Waugh Crigler dismissed one count that claimed Federal law preempted the county’s action in banning the land application of sludge. i
Following that ruling Dr. Werner Krebser withdrew as a plaintiff in the Federal suit. He said he was withdrawing from the state suit as well.
The remaining plaintiffs, Dale Welch, John Harrison Powers, and Patricia Saltonstal, have appealed Judge Crigler’s ruling, and the county has filed a motion to dismiss the appeal as premature, since there still remain other counts in the suit which have not been resolved.
