Judge Crigler noted under provisions of the Clean Water Act “Congress has provided for the reduction of risks and the maximization of benefits associated with the disposal or use of sewage sludge” and charged the EPA with “developing regulations for its disposal and utilization.” However he notes that “the statute further provides...that The determination of the manner of disposal or use of sludge is a local determination, except that it shall be unlawful for any person to dispose of sludge from a publicly owned treatment works ...except in accordance with such regulations.”’
