Rubric auction to the ighest bidder; all that certain estate situate and lying on State Route 640, containing 179.2279 acres, Jackson Magisterial District, Rappahannock County, Virginia, together with all improvements and fixtures thereon, and appurtenances thereunto, more particularly described as follows:

This sale is made subject to filed or unfiled mechanics' liens, if any, and any other matters of record having priority over the deed of trust .being executed and subject to all encumbrances, restrictions, reservations, rights-of-way, conditions and easements, if any, contained in the deeds, instruments and/or documents forming the chain of title to the above property.

TERMS OF SALE: A deposit of Ten Thousand Dollars ($10,000.00) cash or certified check shall be required of the successful bidder at the time of sale. The balance of the purchase price shall be in CASH or its equivalent at the time of settlement, which shall be held on or before THIRTY (30) days after the date of sale. Conveyance shall be by Special Warranty deed, and time shall be of the essence with respect to settlement. The deposit, without interest thereon, shall be applied to the credit of the successful bidder at settlement, which will be held at the offices of the Substitute Trustee, or in the event of purchaser's failure to complete settlement within THIRTY <301 days after the date of sale, the deposit shall be forfeited and applied to the costs of sale, including attorney's fees, and the property shall be resold at the risk and expense of the defaulting purchaser.

The subject property and any improvements thereon shall be sold in "AS IS* condition without warranties of any kind. AH loss or damage to the property from and after the time of the sale shall be at the risk of the successful bidder. Real estate taxes, monthly common expense assessments or other special charges, if any, snail be adjusted as of the date of the sale. Except for payment of the Virginia State Grantors tax, all costs of transferring the property shall be at the cost of the purchaser.

To the extent permissible by law, all bidders, including the successful bidder, waive and release any prior trustees, the Substitute Trustee, the Noteholder and their respective agents, successors and assigns from any and all claims such bidder or their successors and assigns may have now or in the future relating to the environmental condition of the property, including any claims pursuant to the Comprehensive Environmental Response Compensation and Liability Act of 1960, as amended, and all other actions pursuant to state or local laws, ordinances or regulations for any environmental condition of the property.
