"Pollution," for purposes of the ASA, is defined as "any alteration of the physical, chemical or biological properties of any state waters resulting from sedimentation, nutrients, or toxins." If a farm operation is found to be polluting water, they will be given an opportunity to correct the problem by using BMP's and developing a stewardship plan, within a reasonable period of time.
An unidentified person in the audience asked who will determine what the pollution is. Mr. Martin answered that it would be determined by. an jnvestigatign apd that j»WCD people, he and another person from his office were trained to identify water pollution problems. But, because they are talking about a non-point source of water pollution, the decision would sometimes be a subjective decision.
Mr. Stoneman explained that a similar program like the ASA has been in Ohio for ten years and that they handle about 100 complaints annually. During those ten years, he said, only one farmer has been prosecuted or dealt with severely.
One farmer who said he had been farming for 50 years voiced his concern that what he considered pollution someone else might not.
