public utility facilities and thus do not require that the County’s Comprehensive Plan be amended to permit them; and the lack of certification as to the need for an environmental assessment.
Mr. McCarthy, in the letter, informed Sprint PCS that they had the right to appeal the decisions within thirty days, and they did so.
In large part, Sprint PCS' appeal is based upon their assertion that the County does not have the authority to impose certain of the restrictions cited, and that the County's Telecommunications Ordinance is in part, therefore, "erroneous and must be set aside."
According to Mr. McCarthy, their appeal before the Board of Zoning Appeals "says all further consideration of Sprint's applications for PWSF in Rappahannock County until the matter is resolved."
Copies of the appeals are available for public inspection at the Rappahannock County Public Library, and another copy is available for inspection at the Zoning and County Administration Office.
