Bailey has been in custody since the day after Pruitt’s disappearance, on that charge and as the result of a warrant issued by Prince William County authorities for his failure to appear in court for another traffic violation.
He is being ..held without bond and Lynn is seeking the death penalty.
The less severe traffic charge, which was scheduled for General District Court Monday following the indictments, was not pressed in light of the more serious charges, Lynn said.
“We believe the murderV^s willful, deliberate and pre-meditated in the commission of the robbery,” Lynn said following the announcement of the indictments.
The case against Bailey builds as additional evidence surfaces, and additional charges could be levied, Lynn said.
“It’s an ongoing investigation, since it’s been largely circumstantial up to this point,” Lynn said.
The prosecutor would not comment as to whether Pruitt had been a victim of sexual assault as well.
But he did note that investigators have had no contact with Bailey since Williams was assigned to the case.
He also noted Bailey was not aware of the pending indictments.
