“That’s too bad,” countered Davis. He warned the Supervisors that if they approved the mileage claims, he would have “no alternative but to bring legal action to recover improper payment from the recipient and individual Board members” who voted to approve payment.
Eastham repeated his earlier motion to authorize payment and Supervisor Dick Latham seconded.
“I’m not an attorney. I have to vote no if our legal advisor says it’s illegal and we might be subject to suit,” said Supervisor Clarence Baldwin.
Supervisor H. B. Wood stated that he would abstain from the voting since he had not seen Davis’s reasons for considering the particular mileage claims improper.
Luke noted that no reasons were included in Davis’s memorandum.
