Dr. Ouaintance in explaining the Commission’s action. Outside of the applicant and his attorney Douglas Baumgardner, no one spoke in favor of the subdivision. Only Dr. Quaintance appeared in opposition to the development proposal. Baumgardner noted that the rezoning request included one 15-acre lot, two 25-acre lots and two 50-acre lots with the remaining 87.5 acres in the tract not included in the application for rezoning. “Of course, rezoning will preclude any additional subdivision of the lots.” he added.
"Why request a rezoning from conservation to residential subdivision?" asked Planner Walter Masterson.
‘‘The zoning ordinance requires it,” Baumgardner answered. He later explained that Pryde's application technically involved six lots including the 87.5 residual acreage. In addition, he said. Pryde had divided a 25-acre parcel off the tract several years earlier. The Rappahannock Zoning Ordinance stipulates in section 6-1 that “no subdivision containing more than five (5) lots, anyone of which contains less than twenty-five (25) acres, shall be approved by the governing body until the entire area of the proposed subdivision is rezoned as RS-1.”
