Jacobsen said that he thought it had not been the intent of Congressman Robinson to impede the Park Service. Instead, the 7th District representative introduced his bill “to quiet rumors” circulating in Rockingham and Madison Counties that the park now has the authority to purchase and condemn land, according to Jacobsen. The Superintendent noted that he and his staff had tried repeatedly to convince residents of those counties that Shenandoah Park did not have the authorities attributed to it. Jacobsen described Robinson’s bill as “an attempt to lay to rest incorrect and harmful rumors.”
He stressed that the park does not now have the power of emminent domain, which allows park authorities to condemn property.
"Legislation specifically prohibits us from using appropriated funds to purchase property,” Jacobsen stated, adding that he was authorized to buy land with “donated funds” only. “If we were to find an angel who'd give us several thousands of dollars, we could probably go out and buy land," he said.
Jacobsen noted that there was one exception to the prohibition against using appropriated funds for land purchase. Legislation passed in August, 1946, allows the Park Service to use appropriated funds “in order to perfect title for acquiring water rights,” he said.
