Noting that he was appearing under subpoena and not as a willing witness, Payne told Judge Penn that he’d had no agreement with Goode on compensation.

“I will not require an expert witness to testify without compensation,” ruled Penn.

Potter immediately requested a continuance on the grounds that hisside had lost one of its important witnesses.

Crigler objected, maintaining that Potter knew it was a possibility that Payne would not be allowed to testify. He arged that Potter had known since depositions were first taken in the case that the county would fight Payne’s appearance as a witness. “My objection has been continual . . . and is no surprise,” he concluded.

Potter countered that Crigler’s objections had related only to the use as evidence of the letter written by Payne to Davis. “There were never any objections to Mr. Payne’s testifying in a court of law as to what he found out in the course of his investigations,” Potter alledged. After another recess, Judge Penn announced that all reas of the case would be continued until December 11. “I’d appreciate it if you gentlemen can confer and narrow the issues here,” Penn told the attorneys. Give the court your authorities, he suggested, “so we don’t have to stop in the middle of the trial and go look up some law.”
