He redrew some lot lines, dropping one and bringing the total number of lots in the proposed development to 13. In April, 1979, the supervisors turned thumbs down on the application in a split decision, going against the advice of Commonwealth Attorney George Davis. Goode came back once more at the supervisors’ board meeting on September 6 for a final denial.
During this whole course of application and denial, Goode’s suits against the county under both the zoning and subdivision ordinances have been continued—primarily at the developer’s request—time after time.
The final decision expected on Tuesday will now have to wait at least until December 11.
