He claimed that minutes for the 1973 supervisor meeting in question, show neither the amendments to the subdivision ordinance enacted at that time nor the map on which the county’s zoning districts are based.
Even assuming that the ordinances are valid. Potter continued, their provisions have been applied in an arbitrary and unreasonable manner by the supervisors. He pointed out that the land around Goode’s tract is used for residential purposes, not for farming. According to Potter, the county has planned for growth in three areas and one of those areas is Flint Hill. He added that it was not economically feasible to farm the tract Goode owns and pointed to approvals for the subdivision from highway, health and soil and erosion officials.
