could be done before “wet November weather set in,” and that she invited the Kidwells to meet with her to discuss the improvements.
The Kidwells hired a lawyer “who immediately threatened litigation if she went forward with the plumed improvements, despite plaintiffs (Saltonstall’s) express right to improve and use the right of way.” Saltonstall continued to try to communicate with the Kidwells about the improvements, according to the Saltonstall suits.
Saltonstall’s counsel informed the Kidwells on November 8, 1982 that the work would begin on the road the next day. On November 9, Ranee Spellman, foreman of Points of View Farm, began bulldozing the roadbed, and was shot and killed by Diane Kidwell. Kidwell was indicted for murder, and found not guilty by reason of self-defense in October 1983.
On the same day of Spellman’s death, the Kidwells filed a Bill of Complaint in Circuit Court which enjoined or prevented Saltonstall from improving the road. The court ruled on January 30,1984 that the Kidwells “had no
