Supreme Court recently overturned — pleaded guilty to two involuntary manslaughter charges Tuesday in Warrenton.
Warren Wesley Essex, 28, was the first person in Virginia convicted of murder in a drunken driving case. He was involved in a November 1981 wreck which killed three Fauquier teenagers. A year later, a Fauquier jury found Essex guilty on three counts of second-degree murder.
But the state’s highest ruled last month that the prosecution failed to prove Essex had acted maliciously and overturned the convictions.
Fauquier Circuit Court Judge W. Shore Robertson this week sentenced Essex to five years on each of the manslaughter charges. The sentences were to run concurrently, but the judge dismissed them because Essex had already served 15 months in jail on the murder convictions.
The other manslaughter and driving under the influence charge were dismissed.
