bid price due at time of settlement. Settlement shall be held on or before thirty (30) days from the date of sale; time shall be of the essence. The deposit shall be applied to the credit of the successful bidder at settlement or, in the event of the failure of purchaser to complete settlement within thirty (30) days after the date of sale in accordance with terms of sale, the deposit shall be forfeited and applied to the costs of sale, including Trustees' fees, and the property shall be resold at cost and expense of defaulting purchaser. The balance of the purchase price shall be paid in cash or its equivalent at the time of ■ settlement. The real property and any improvements thereon shall be sold in ‘as is' condition without warranties of any kind. All costs of the conveyance, which shall be by special warranty, examination of title, recording charges,notary fees, settlement fees, including preparation of deed and grantor's tax thereon, etc., shall be at the costs of the purchaser. This sale is subject to the covenants, conditions, restrictions, rights of way and easements, if any, contained in the deeds forming the chain of title to the above property. This sale is further subject to recorded and unrecorded mechanic's and materialmen's liens, if any. Information as to the status of record title and the improvements on the real property and all documents available to the Trustees may be examined by prospective purchasers at the offices of the Attorneys for the Noteholders on Monday through Friday, inclusive, or each day (exclusive of legal holidays), between 10:00 a.m. and 4:00 p.m. Written notice of this Trustee's Sale, as required by Va.
