Virginia Military Institute has asked the U.S. Supreme Court to review the decision of U.S. Court of Appeals for the Fourth Circuit on the constitutionality of the Institute’s single-sex admissions policy.
In its petition to the Court, VMI argued that if the Fourth Circuit’s ruling is allowed to stand, public authorities nationwide will be highly uncertain as to the constitutionality of single-sex education.
This uncertainty, says the petition, “can only act as a powerful deterrent to the continuation of publicly supported single-sex education and to experimenation with single-sex education in new settings.”
This would be ironic, says the petition, because “recent educational scholarship provides new evidence of the benefits of single-sex education.”
VMI, a four-year undergraduate institution for young men, was founded in 1839 in Lexington, Va. It is part of the state of Virginia’s system of higher education, which includes 14 other colleges and universities. Each of these schools has a board of visitors, which is authorized to determine admissions policy.
