The motions to strike were made, with Mr. Williams saying that the defendants did not go to the house with the intent to steal anything, something that would have had to be shown if they were to be found guilty of breaking and entering, and Mr. Morgan also said that no intent was shown. "They just wanted to see a haunted house," he said. Mr. Luke argued that they did break and enter, and that nobody had permission to enter the house. Instead of coming out of the house when the police arrived, he said, they concealed themselves in the house. "Items were moved throughout the house. This was an entering with the intent to commit larceny," he said. The breaking and entering and unlawful destruction charges were dismissed, and both defendants then decided to plead guilty to unlawful entry instead of going ahead with the jury trial on that charge.
