He also noted that Virginia ABC and Federal ATF both make no distinction between breweries and wineries and, in the absence of a definition of a brewery in Rappahannock County ordinances, he contended that the equivalency should stand as well in the County.
There was also a difference of opinion by the appellant and by the Zoning Administrator as to Mr. Stewart's original intent with regard to brewery operations and as to what operations were permissible under the County's zoning ordinance. Mr. McCarthy produced communications that indicated that Mr. Stewart had committed, in 1997, to a brewery that would produce a product to be shipped out-of-County and that would not engage in any form of onsite sales.
