SPERRYVILLE, VIRGINIA 22740

IN EXECUTION of a deed of trust from Philip Lee Thornton. Ill and Carolyn T. Thornton, dated December 17, 1998, and recorded in the Clerk’s Office of the Circuit Court of Rappahannock County, Virginia, as Instrument No. 98-1945, default having been made in the payment of the debt therein secured and being required to do so by the noteholder, the undersigned Substitute Trustee will offer for sale at public auction at the front door of the Rappahannock County Circuit Courthouse, 238 Gay Street, Washington, Virginia, on March 19, 2002, at 3:00 o’clock, p.m., the following described real estate, to-wit:

A parcel of land in Piedmont District,

Rappahannock County, Virginia, bounded

and described as follows: “Beginning at

figure I on map an iron hub on Lee Highway

and corner to Herman Aylor, thence

with Highway S 64-1/2 W 168-1/2 feet to

figure 2, a point on highway, thence

leaving highway S 23-3/4 E 306 feet to

figure 3, a point in Thornton River, thence

down river N 41-1/2 E 101 feet to figure 4,

thence N 15-1/2 E 124 feet to figure 5,

corner to Aylor, thence with Aylor N 23-3/4

E 174 feet to the beginning containing one

acre.” Reference is made to the aforesaid

deed of trust for a more particular

decription.

This property is located at 5 Snead Lane, Sperryville, Virginia. The property is identified by tax map number 38-11.

The property shall be sold in “as is” condition without warranty of any kind; subject to filed or unfiled mechanics liens, if any exist; subject to the right of redemption of the United States of America, if it exists; subject to matters of record having priority over the Deed of Trust being foreclosed if any exist; and subject to all easements, restrictions and reservations in the chain of title.

TERMS OF SALE: Cash. A bidder's deposit of 10% of the purchase price in cash or certified check may be required at the time of sale. The balance shall be paid at settlement to be held within fifteen (15) days after the date of sale. The Substitute Trustee may extend the time for settlement. Examination of title, conveyancing, and recording fees shall be at the expense of the purchaser. Real estate taxes will be prorated to the date of sale. The Substitute Trustee may reject all bids and withdraw the property from sale Additional terms of sale may be announced at the sale.
