Rappahannock County, Virginia, on the

north side of State Route #640, as shown

on a plat of Aaron Mountain Surveys

dated October 10, 1998. said plat being

recorded with Instrument No. 98-1717 in

the Clerk’s Office of the Circuit Court of

Rappahannock County, Virginia.

AND BEING the same property conveyed

to Michael Shawn Cooke and

Tracey Marie Cooke by deed dated and

recorded November 16, 1998 in the aforesaid

Clerk’s Office as Instrument No. 981717

and by deed of correction dated

December 25, 1998 and recorded December

29, 1998 as Instrument No. 982017

in the aforesaid Clerk’s Office.

TERMS OF SALE: CASH

A deposit of Five Percent (5%) of the sale price in cash or certified check may be required to be paid by the successful bidder at the time ot sale with the balance due in cash or its equivalent at settlement which will be held on or before twenty-one (21) days from the date of sale at the office of the Trustee; terms of sale to be complied with within twenty-one (21) days after the date of sale or the above deposit will be forfeited, applied to costs of the sale, including Trustees' fees, and the property shall be resold at the cost of the defaulting purchaser. Time shall be of the essence with respect to settlement. All costs of conveyance, examination of title, State Grantor’s Tax, notary fees, and other costs of settlement shall be at the expense of the purchaser.

The subject property and any improvements thereon shall be sold with special warranty of title. The subject property and any improvements thereon shall be sold in “as is" condition without warranties of any kind. Real estate taxes shall be adjusted as of the date of settlement.

Information as to the status of record title and the improvements on the above described real property and all documents available to the Trustee may be examined by prospective purchasers at the offices of the Trustee on Monday through Friday, inclusive, or each day (exclusive of legal holidays)] between 8:30 a.m. and 5:00 p.m.

The Trustee reserves the right: (i) to waive the deposit requirement; (ii) to extend the period of time within which the purchaser is to make full settlement; (iii) to withdraw the property from sale at any time prior to the termination of the bidding; (iv) to keep the bidding open for any length of time; (v) to reject all bids; and (vi) to postpone or set over the date at the time of sale or continue this sale frpm time to time; such notices of postponement or setting over will be in a manner deemed reasonable by the Trustee.
