added that, without conditions attached to the rezoning, anything from a McDonald’s to a large retail store to a night club could move into the property if McCue decides to sell the land.
“The issue is not Dr. McCue. He’s a great guy, he’s a great doctor, he’s an asset to the community,” Konick said. “But the issue that’s before the board ... is does this application meet the standards that are set out in the zoning ordinance, and the answer is no, it doesn’t.”
Konick said the argument in favor of McCue is “compelling on emotional grounds,” but none of the doctor’s supporters mentioned anything about zoning regulations.
“You’ve got to look at this not on the basis of the individual applicant. You’ve got to look upon it on the basis of what future uses could be made on this property,” Konick said. “Get out your zoning ordinances ... and see eveiything that’s permitted by right in a general commercial district. There’s a lot of things in there.”
He also noted that McCue has an 18-foot right of way for his driveway that accesses U.S. 211, while the county requires a 20-foot driveway for commercial properties to allow two cars to pass simultaneously.
“If you’ve got rules, apply them; if you don’t like the rules, then change them,” Konick said.
“There’s a lot of different things that the board could do to come up with a solution that wouldn’t break the rules and would accommodate what he needs to do, and everyone would be happy,” he said.
McCarthy asked Konick if the Browns would be satisfied with a proffer from McCue that would limit the intensity of any future commercial use on the property.
Both parties seemed open to working out a solution that would allow Mountainside to hire more employees while putting to rest the Browns’ concerns about future uses on the site.
