Supervisors had an obligation to pay the BZA’s legal fees.
However, he noted that the BZA’s action in making a decision to fight the writ filed by the ski area and afterwards applying for funds to pay an attorney was a "sore sticking point” with the Supervisors. Luke added that he’d heard private groups in the county were willing to raise money to cover the BZA’s legal costs and cautioned citizens that such action was illegal.
“No, it’s not illegal,” interjected Davis.
Luke qualified his remark by explaining that all dispersals of money by the'' BZA required approval from the Supervisors. Private citizens could organize a fund drive but the records would have to be audited by the Supervisors’ accountant and all money would first have to be deposited in the general fund before transfer to the BZA account, according to the Supervisor Chairman.
