According to Luke, plea bargaining generally occurs when crowded court dockets made prosecution of all cases impossible. Court load in Rappahannock County is not heavy enough to make it necessary to resort to this, he said. Luke stated that he would plea bargain, allowing a defendant to plead guilty to a lesser charge, only if the individual would otherwise walk out of court with no conviction.
“There are cases that call for it (plea bargaining). You want a man in the Commonwealth Attorney’s office who is going to make bargains in the best interest of Rappahannock County,” Luke said.
