The last of charges brought by Myrtle F. Corbin in a S2.S million lawsuit against the Rappahannock County sheriffs department have been thrown out of court.
Chief U.S. District Judge James C. Turk dismissed the case against deputy sheriff and jailor John Mannion on April 8. Earlier, Sheriff W. A. Buntin and Rappahannock County were dismissed as defendants in an order entered on December 11. 1979.
Mrs. Corbin filed the action on behalf of her son, Bobby Lee Corbin, who died December 26, 1978, of injuries he sustained in an automobile accident while driving under the influence of alcohol on Christmas Day.
Following the accident, he was taken to the county jail and held from 6:30 p.m. on the 25th until 10:30 a.m. the next day. He collapsed shortly after his release and died a few hours later in Warren Memorial Hospital.
In her suit, Mrs. Corbin alleged that the defendants—the county. Sheriff Buntin and deputy Mannion—failed to provide her son with proper medical treatment while he was in custody. She charged that actions in denying or refusing medical treatment were the cause of Corbin’s death.
