Corbin immediately to a hospital, his mother took him home, Judge Turk noted. After some time passed, she called the rescue squad and Corbin was taken to Front Royal Hospital where he died shortly after arrival, according to the memorandum.
While noting the prisoners are entitled to reasonable medical care. Judge Turk ruled that no constitutional deprivation occurred in Corbin’s case because treatment was offered but refused by the inmate.
In dismissing Mrs. Corbin’s suit, Turk concluded that Mannion’s actions did not constitute deliberate indifference.
Instead, Turk maintained, Mannion was "particularly solicitous” of Corbin’s physical condition.
In a letter to Mannion, John C. Lowe, Charlottesville attorney who represented the jailor, acknowledged that it is possible for the Corbins to appeal Turk’s order but maintained it is highly unlikely that they will do so. "Justice has triumphed, once again,” Lowe concluded.—D.H.
