Nominations, each for a sixyear term, are voted on by the full assembly but with Democrats in control, approval of the selections made in the party caucus is, with few exceptions, a foregone conclusion. The same generally applies to reconfirmation of judges who seek appointments for subsequent terms.
The subject came up when Durrette was asked what could be done to avoid repetition of a Southwest Virginia judge’s controversial decision to release convicted marijuana dealers who had served only a fraction of their sentences.
“Elect a majority of Republicans” and the incident won’t be repeated, Durrette answered. “The process by which we elect judges is unfortunate (and) highly politicized,” he maintained, adding that it doesn’t provide for review of performance at the end of judicial terms prior to reappointment.
