In addition, the complaint notes that Buntin repeatedly has requested reconsideration of the action to bar his participation and has asked for a hearing, denied by letter dated July, 1980.
The suit contends that Buntin has been discriminated against on the basis of age through the trustees' actions described as "arbitrary and capricious and without any rational basis or legitimate purpose on behalf of the state.”
In addition, it alleges that the sheriff has been deprived of his rights to due process under law by the discontinuance of his vested property right in the retirement system without a hearing.
